Extend the Privilege

The Tennessee Supreme Court recently extended the attorney-client privilege to third parties who act as the functional equivalent of an employee when the communications are related to the attorney’s representation of the business and were intended to be confidential. The business was a medical clinic and the third party was the property management company hired by the medical clinic to manage the properties.
The effect of this ruling was to protect emails between the medical clinic and the property manager.
