Overcome the Myths of Mediation
Jul 05, 2016
When you have a legal issue, you may think you need to prepare for an episode of “Law & Order.” Fortunately, though, your legal case does not have to be a huge dramatic episode in your life. There is a way to help come to a solution without pulling out all the emotions - and money! - from your life. And no, mediation is not you “chickening” out. Instead, it is you handling your case with maturity.
Myth From Fact
There are many misconceptions when it comes to taking your legal case to mediation instead of court. One is mentioned above, which is taking the so-called “easy” way out. In fact, mediation can be seen as just as hard a method to go through as a court case because it causes you to dig deep in order to come to a compromise and a solution. While the benefit of mediation is that it puts the ball more in your court than the actual court room, it does mean you are really going to have to put your emotions to the side and compromise your case the best you can.
Some also believe that mediation is just a waste of time—that they will actually end up paying more money because they will now have to pay for mediation and for court. However, the fact is that most cases can be resolved in mediation, helping both parties to save in lawyers’ fees and court costs. And, even if it does end up going to court, mediation can help parties get further down the road in resolving issues so that court is only needed for one or two issues that could not be resolved, instead of all the issues that may have been legal problems in the beginning. This will save at least some time and money where court is concerned.
