LWDN Attorneys Dana Holloway and David Chapman obtained a defense win recently for a package car company they defended. A package car driver was driving in Roane County on a 4 lane highway with a grass median with the usual cross over points allowing vehicles to turn left. The package driver was in the left lane. He said a car turned left into one of the cross overs abruptly from the right lane causing him to slam on his brakes and veer left to try and avoid hitting the car. He went into the median, crossed over, and struck the car. Driver and passenger of the car (passenger was plaintiff-driver of other car was LWDN's co-defendant) said they were just driving along in the left lane in front of package driver, turned on the left signal and were in the process of making a legal left turn when package driver lost control and ran into them in the median. Plaintiff claimed over 55k in medical, which LWDN argued was not related. Jury put 100% on co-defendant and 0% on package driver and awarded total damages of $0.
